These terms and conditions govern the sale of BrainSmart branded products on www.brain-smart.net. Please read them carefully before ordering. By placing an order you agree to be bound by these terms.
About us
The Website and BrainSmart brand are operated by Cognitive Bioscience UK Limited, a company registered in England & Wales (company number 14557197), registered office 1 Coldbath Square, London EC1R 5HL (“we”, “us”, “our”). You can contact us at customerservice@brain-smart.net.
Our contract
When you place an order on our Website, that is an offer to buy. We accept your order when we send you an order confirmation or dispatch email. The contract between us is formed at that point.
Price and payment
Prices are shown on the Website and include shipping and handling. You can pay by Mastercard, Visa or PayPal. We may ask to receive payment before we dispatch your products. We are not obliged to fulfil an order for a product advertised at an incorrect price; if a pricing error occurs we will give you the option to cancel or to confirm the order at the correct price.
Delivery, ownership and risk
Products are usually dispatched the same day for orders placed before 12:00 GMT, or within 24 hours otherwise. Estimated delivery is 5–10 business days; during busy periods this may be longer. Ownership of and responsibility (risk) for the goods pass to you when the goods are delivered to you.
Your right to cancel and returns
If you are buying online you have a legal right to cancel within 14 days under the Consumer Contracts Regulations 2013, in addition to our money-back guarantee. Special offers, sales and discount vouchers
BrainSmart special offers and purchases made using discount codes (for example, “Buy 2 get 1 free”) are intended for first-time customers and are valid for one use per customer. Outside your statutory rights, we do not provide goodwill refunds on goods purchased using voucher codes or special offers.
Our liability
If we breach these terms, our liability is limited to refunding the price you paid for items you have not received or have returned within the agreed timescales and condition, and to any other loss or damage that is a foreseeable result of our breach or negligence. We do not accept liability for errors or omissions on the Website and reserve the right to correct them. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law, including your statutory rights as a consumer.
Events beyond our reasonable control
We are not responsible for any delay or failure to meet our obligations caused by events beyond our reasonable control. This does not affect your legal rights.
Changes to these terms
We may update these terms at any time. You are subject to the terms in force when you place your order, unless a change is required by law or a regulatory authority. If any provision is found to be invalid or unenforceable, the remaining provisions continue in force.
Your personal data
We process your personal data in accordance with our Privacy Policy, which explains what we collect, how we use it, who we share it with and your rights. We do not sell your personal data. You can opt out of marketing at any time by emailing customerservice@brain-smart.net or using the unsubscribe link in any marketing message.

Governing law and jurisdiction
These terms and any dispute arising from them are governed by the laws of England & Wales, and are subject to the non-exclusive jurisdiction of the courts of England & Wales. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
